Terms of Service

These Terms govern your use of dirtclaude.ai, the dirtClaude map application, Auggie chat, the prediction API, and related mobile apps (together, the "Service"). By using the Service you agree to these Terms.

SCREENING ONLY. Everything the Service produces — claim status, "open ground" flags, L-208 screens, mineral prospectivity scores, water and geology layers, AI answers — is a research screening aid, not legal claim clearance, a title opinion, mineral-rights certification, survey data, or investment advice. Claim boundaries render at PLSS-aliquot accuracy, not GPS-staked corners. Always verify with BLM MLRS and the county recorder before any field activity, filing, or purchase.

1. The Service

dirtClaude aggregates public geoscience data (USGS, AZGS, BLM, ADWR, NRCS, NASA and others), applies AI/statistical models, and presents the results on an interactive map. Model output is probabilistic and can be wrong. Data sources update on their own schedules and may lag reality.

2. Accounts, Plans & Billing

Free features are provided as-is. Pro features are subscription-gated: $9.99/month or $99/year (prices may change with notice).
Payments are processed by Stripe; we never see or store your card number.
Subscriptions renew automatically until cancelled. Cancel anytime from the billing portal — access continues to the end of the paid period. Except where required by law, partial periods aren't refunded.
One-off products (e.g. due-diligence report PDFs) are delivered digitally and are non-refundable once generated.

3. Field Safety & Land Access — your responsibility

Abandoned mines are deadly: shafts, bad air, unstable workings. Stay out, stay alive.
Desert water features flash-flood; flow flags in the app are estimates, not gauges.
You are solely responsible for land-access rights: private property, active claims, State Trust land permits, tribal-land permission (e.g. Havasupai, White Mountain Apache), and USFS/BLM rules. A dot on our map is never permission to enter or collect.
Meteorite and mineral collecting is regulated differently by land status — know the rules for the ground you're on.

4. Acceptable Use

Don't scrape, resell, or redistribute the Service or its derived layers; don't abuse the API or attempt to bypass Pro gates; don't use the Service to violate any law or land-use rule. We may throttle or terminate accounts that do.

5. Your Content

GPS tracks, waypoints, photos, and feedback you submit stay yours. You grant us a license to store and process them to run the Service (sync, backups, model calibration). Prediction feedback (👍/👎 grades) may be used in de-identified aggregate to improve the models.

6. Intellectual Property & Attribution

The Service's code, design, branding (including Auggie ✺), and derived data layers are ours. Underlying public data belongs to its providers: USGS (MRDS, 3DEP, GNIS, NHD), AZGS/University of Arizona, BLM (MLRS, SMA), ADWR, NRCS, NASA/Meteoritical Society, Macrostrat, OpenStreetMap contributors, Mapbox, Wikimedia Commons, Sharlot Hall Museum. Their terms apply to their data.

7. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MINE DATA INTELLIGENCE, LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES — INCLUDING LOSSES FROM FIELD ACTIVITY, CLAIM FILINGS, OR RELIANCE ON SCREENING OUTPUT — AND OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

8. Changes & Termination

We may update the Service and these Terms; material changes will be posted here with a new date. Continued use after changes is acceptance. We may suspend the Service for maintenance or discontinue features.
